Appeals: Court Sides With Developers In Fight Over Condo Deposits

Developers fighting condo depositors trying to get their money back got help when a federal appeals court made it easier to shift their cases from state to federal courts.
The 11th U.S. Circuit Court of Appeals ruled a proposed class action against West Palm Beach builder Kolter City Plaza II should be heard in federal court based on the Class Action Fairness Act of 2005, which allows removal when the disputed amount is more than $5 million.
